The Data Protection Act 1998 controls how your personal information is used by organisations, businesses or the government.
As an organisation the Police and Crime Commissioner’s (PCC’s) office is bound by the Act to provide an individual any information we may hold about them, should they request it and to ensure any data we do hold is treated in a responsible manner. Avon and Somerset Police is a separate organisation to the PCC so any Data Protection Act or personal data related enquiries about information held by the Police should be directed to the Police.

Data protection principles
Anyone processing personal data must comply with the eight enforceable principles of good practice.
The information must be:
- Processed fairly and lawfully
- Processed for limited purposes
- Adequate, relevant and not excessive
- Accurate and up-to-date
- Not kept longer than necessary
- Processed in accordance with the data subject's rights
- Not transferred to countries outside EEA without adequate protection
How we use your personal information
Our Fair Processing Notice explains how the Avon and Somerset Police and Crime Commissioner (PCC) obtains, holds, uses and discloses information about people - their personal information, the steps we take to ensure that it is protected, and also describes the rights individuals have in regard to their personal information handled by the PCC.
The use and disclosure of personal information is governed in the United Kingdom by the Data Protection Act 1998 ('the Act'). The PCC is registered with the Information Commissioner as a 'Data Controller' for the purposes of the Act. As such the PCC is obliged to ensure that the PCC’s office handles all personal information in accordance with the Act.
The PCC takes that responsibility very seriously and takes great care to ensure that personal information is handled appropriately in order to secure and maintain individuals trust and confidence.

The Data Protection Act provides the right for an individual to request a copy of personal information held about them by a data controller. This is known as 'subject access'.
If you would like to find out whether the PCC holds any personal information about you and would like a copy of that information you can write to the PCC using the address below.
Please note: The Act states that there is a £10 fee for Subject Access Requests.
